Terms of Service

1. Acceptance of Terms

By accessing or using DXED ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

2. User Accounts

You must be at least 13 years of age to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration.

3. User-Generated Content

You are solely responsible for any content you post, upload, share, or otherwise make available on the Platform, including but not limited to text, images, videos, clips, comments, and profile information ("User Content").

By posting User Content, you represent and warrant that:

You grant DXED a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Platform.

DXED employs automated content moderation systems, including AI-based image and video scanning, to detect and prevent the posting of prohibited content. Content flagged by our systems may be automatically removed or blocked.

We reserve the right, but are not obligated, to review, monitor, edit, or remove any User Content at our sole discretion, for any reason or no reason, with or without notice.

6. Account Termination

We may suspend or terminate your account at any time, with or without cause, with or without notice, for violations of these Terms or for any other reason. You may delete your account at any time through your account settings.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DXED DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DXED AND ITS OPERATORS, AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

DXED is not responsible for any User Content posted by its users. Users post content at their own risk and are solely responsible for the legal consequences of their posted content.

9. Indemnification

You agree to indemnify, defend, and hold harmless DXED, its operators, affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or related to your User Content, your use of the Platform, or your violation of these Terms.

DXED offers paid subscription plans ("DXED Pro" and "DXED+") that provide access to premium features. By subscribing to a paid plan, you agree to the following:

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through binding arbitration.

Privacy Policy

1. Information We Collect

Account Information: When you register, we collect your username, email address, and password (stored securely hashed). You may optionally provide a display name, avatar, bio, and other profile information.

User Content: We store content you post including text, images, videos, comments, and messages.

Device Information: We may collect browser type, operating system, and IP address for security and analytics purposes.

Subscription Plans

DXED offers the following paid subscription plans:

All subscriptions are billed monthly on a recurring basis through our payment processor, Stripe. Your payment method will be charged automatically at the start of each billing cycle.

No Refund Policy

ALL SALES ARE FINAL. DXED DOES NOT OFFER REFUNDS FOR ANY SUBSCRIPTION PAYMENTS UNDER ANY CIRCUMSTANCES.

Cancellation

You may cancel your subscription at any time through the "Manage Subscription & Billing" button on the Plans page, or through your Stripe billing portal. Upon cancellation:

Payment Failures

If a recurring payment fails, we may attempt to charge your payment method again. If payment cannot be collected after multiple attempts, your subscription may be cancelled and your account will revert to the Free plan.

Price Changes

DXED reserves the right to change subscription pricing at any time. Existing subscribers will be notified at least 30 days before any price increase takes effect. Continued use of the service after a price change constitutes acceptance of the new pricing.

Chargebacks & Disputes

Filing a fraudulent chargeback or payment dispute for a legitimate subscription charge is a violation of these terms and may result in immediate account termination. If you believe a charge was made in error, please contact us through the Platform's support channels before initiating a dispute with your bank.

DMCA Policy

Digital Millennium Copyright Act Notice

DXED respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement that are reported to our designated copyright agent.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Platform, please notify our designated copyright agent with the following information:

  1. A physical or electronic signature of the copyright owner or authorized representative
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material on the Platform that is claimed to be infringing, with enough detail to locate it
  4. Your contact information (address, phone number, email)
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner

Counter-Notification

If you believe your content was removed in error, you may file a counter-notification containing:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. Your name, address, phone number, and a statement consenting to jurisdiction

Repeat Infringers

In accordance with the DMCA, DXED will terminate the accounts of users who are found to be repeat infringers. We maintain a policy of tracking repeat violations and taking appropriate action.

Safe Harbor

DXED operates as a platform for user-generated content. Under Section 512 of the DMCA, we qualify for safe harbor protection as a service provider that:
